Acceptable Use Policy

3.1 Purpose

This Acceptable Use Policy (AUP) sets out the rules governing use of Struxo Quotes (the Platform). It exists to protect the integrity of the Platform, protect other users, and ensure the Platform is not used for fraudulent, harmful, or unlawful purposes. By using the Platform you agree to comply with this policy. Breach of this policy may result in immediate suspension or termination of your account.

3.2 Permitted Use

The Platform is intended exclusively for use by:

  • Licensed builders holding a current residential builder's licence in an Australian state or territory, using the Platform to generate estimates and quotes for Australian residential construction projects
  • Licensed trade contractors holding a current trade licence in an Australian state or territory, submitting trades quotes for inclusion in residential building estimates

Permitted uses include:

  • Generating estimates and quotes for Australian residential building and trade work from plans and drawings
  • Managing client communications and leads related to residential building and trade projects
  • Submitting and receiving trades quotes for inclusion in residential project estimates
  • Storing and managing project-related documents within your account

3.3 Explicitly Prohibited Users

The following persons must not register for or use the Platform under any circumstances:

  • Homeowners, regardless of whether they are managing their own building project
  • Owner-builders, even where they hold an owner-builder permit
  • End clients or customers of builders or trades
  • Architects and architectural designers, regardless of their registration status or the nature of the project they are working on
  • Project managers, consultants, quantity surveyors, or other parties who are not themselves licensed builders or trade contractors
  • Builders or trades whose licence does not cover residential construction
  • Builders or trades operating in the commercial, civil, or industrial construction sectors

The exclusion of architects applies to architects acting independently as Platform users. Architects may provide plans and drawings to a licensed builder who uses the Platform, but the architect in that scenario is providing source documents to the builder, not using the Platform themselves.

Whilst we take reasonable steps to communicate these eligibility requirements, we cannot guarantee that all users of the Platform meet the requirements. We accept no liability for use of the Platform by ineligible persons. See section 2.2A of the Terms of Service.

3.4 Prohibited Use

Scope and Sector Restrictions

  • Generate quotes or estimates for commercial, civil, industrial, or non-residential building projects of any kind
  • Generate quotes or estimates for work in a state or territory where you do not hold a current licence
  • Generate quotes or estimates for work that falls outside the scope of your current licence
  • Use the Platform on behalf of a homeowner, owner-builder, or end client
  • Use AI-generated outputs for any project type other than Australian residential construction

Fraudulent or Deceptive Conduct

  • Generate quotes or estimates that intentionally misrepresent the scope, pricing, or inclusions of building work
  • Create documents that impersonate another builder, trade, or business
  • Submit false or misleading information during account registration or at any time thereafter, including false licence or insurance details
  • Use the Platform to facilitate or conceal unlicensed or uninsured building or trade work
  • Generate pricing or scope documents designed to mislead homeowners or clients in breach of the Australian Consumer Law
  • Represent your licence status, insurance status, or qualifications inaccurately to any client using Platform outputs

Intellectual Property Violations

  • Upload plans, drawings, or documents that you do not have the right to use or share
  • Use the Platform to reproduce or distribute copyrighted building designs without appropriate authorisation
  • Attempt to extract, copy, or replicate proprietary elements of the Platform or its AI systems

Regulatory Non-Compliance

  • Use Platform outputs to circumvent or misrepresent compliance with applicable building codes, standards, or licensing requirements
  • Generate a quote or estimate and represent it as a residential building contract without complying with applicable home building legislation in your state or territory
  • Use Platform outputs as a substitute for mandatory written contract requirements under applicable residential building legislation

Platform Integrity

  • Attempt to probe, scan, or test the vulnerability of the Platform or its underlying infrastructure
  • Use automated scripts, bots, or scraping tools to access or extract data from the Platform
  • Introduce malware, viruses, or any code designed to disrupt, damage, or gain unauthorised access to the Platform
  • Share your account credentials with individuals outside your authorised business team
  • Create multiple accounts to circumvent subscription limits or access restrictions

Harmful or Unlawful Content

  • Upload or transmit content that is defamatory, threatening, harassing, or discriminatory
  • Use the Platform to transmit spam or unsolicited commercial communications
  • Upload content that contains or facilitates illegal activity of any kind

3.5 AI-Specific Prohibited Use

Given the AI-assisted nature of the Platform, the following additional prohibitions apply:

  • You must not represent AI-generated outputs as having been prepared by a licensed quantity surveyor, engineer, or other regulated professional
  • You must not use Platform outputs without review and approval as the basis for a binding contract or financial commitment
  • You must not attempt to manipulate or deceive the AI systems to produce outputs that misrepresent costs, scope, or compliance
  • You must not use the Platform to generate documents in the name of another person or entity without their authorisation
  • You must not use AI-generated cost data as a substitute for obtaining actual subcontractor and supplier quotes for the specific project
  • You must not use AI-generated scope descriptions as a substitute for discussing and confirming scope with the client before issuing a quote

3.6 Verification Step Obligations

The Platform includes mandatory in-platform verification checkpoints at key stages of the workflow, including before any quote or estimate is sent to a client. These checkpoints require you to confirm that you have personally reviewed and verified the AI-generated content before it is issued.

You must not:

  • Complete a verification step without having genuinely reviewed, checked, and where necessary corrected the relevant Platform outputs
  • Instruct, encourage, or permit any team member or account user to complete a verification step as a formality without conducting a genuine review
  • Represent to a client that a quote or estimate has been independently reviewed when the verification step was completed without a genuine review having occurred

Completing a verification checkpoint without genuine review is a breach of this policy and of the Terms of Service, and may constitute misleading or deceptive conduct under the Australian Consumer Law. The Platform logs a timestamped record of each verification step completion. These records may be used in the event of a dispute.

3.7 Reporting Misuse

If you become aware of another user misusing the Platform, or if you suspect fraudulent activity, please report it to us immediately at info@struxo.com. We investigate all reports and take appropriate action, which may include account suspension, termination, and referral to relevant authorities.

3.8 Consequences of Breach

Breach of this Acceptable Use Policy may result in:

  • Immediate suspension or permanent termination of your account without refund
  • Referral to relevant regulatory authorities, including state building and trade licensing regulators or the ACCC
  • Legal action where the breach has caused loss or damage to us or to third parties

We reserve the right to investigate suspected breaches and to cooperate with law enforcement or regulatory bodies as required.

3.9 Changes to This Policy

We may update this Acceptable Use Policy from time to time. Material changes will be communicated with at least 14 days' notice. Continued use of the Platform following notice constitutes acceptance.
